These Terms of Service ("Terms") govern your use of the Octet Operator mobile application ("App") operated by MMCX LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, or distribute the App; reverse engineer or decompile it; use it for any illegal purpose; attempt to circumvent purchase restrictions; or use automated systems to interact with it.

2. The App

Octet Operator is an educational and professional training platform for IP networking and AV-over-IP protocols. It combines interactive learning with field tools. We do not guarantee any particular outcome, including certification exam results or job performance.

3. Subscriptions and Payments

The App offers multiple access levels, including free and premium tiers. Premium access may be offered through auto-renewing subscriptions or one-time purchases. Specific pricing and tier details are displayed within the App and on the App Store listing.

Payment is charged to your Apple ID. Auto-renewing subscriptions renew unless canceled 24 hours before the billing period ends. Manage subscriptions in iOS Settings. Refund requests are handled by Apple.

4. Intellectual Property

The App and its content are owned by MMCX LLC and protected by copyright, trademark, and other intellectual property laws.

5. User Content

The App does not allow user-generated content. Game data and settings are stored locally on your device.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted or error-free operation.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMCX LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Total liability shall not exceed the amount paid for the App in the preceding 12 months.

8. Indemnification

You agree to indemnify MMCX LLC from claims arising from your use of the App or violation of these Terms.

9. Termination

We may terminate access for breach of Terms. Upon termination, your license ends.

10. Changes

We may modify these Terms at any time with notice via updated date and in-App notification for material changes.

11. Governing Law

These Terms are governed by the laws of the State of California.

12. Dispute Resolution

Informal resolution first (30 days). Then binding arbitration in Los Angeles County, California. Class action waiver applies. Small claims exception exists.

13. Severability

Unenforceable provisions do not affect the remaining Terms.

14. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement.

15. Apple-Specific Terms

These Terms are between you and MMCX LLC, not Apple. Apple has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries.
